As many of you know, the criminal laws in Arizona frequently change. Because we believe it is very important for our clients to be aware of any revisions in the law, Palmisano & Associates will now provide notices to our clients whenever our laws do change.
We also find that many people are not aware of what their constitutional rights are when contacted by police.

NEW CRIMINAL DUI LAWS
The following laws took effect in 2006:
(1) The period for enhanced punishment for an Arizona DUI conviction was recently extended by 2 years. Prior to the recent change, a 2nd Arizona DUI conviction within a 5 year period carried more severe punishment than a 1st Arizona DUI conviction and a 3rd Arizona DUI conviction within a 5 year period constituted a class 4 felony. The time frame for enhanced punishment has been extended from 5 years to 7 years.
Now, a 2nd Arizona DUI conviction within a 7 year period carries a minimum penalty of 30 days jail; $5,230 fine; and a driver's license revocation for 1 year followed by the installation of an ignition interlock device. A 3rd Arizona DUI conviction within a 7 year period is a Class 4 felony carrying a minimum sentence of 4 months prison as a condition of probation.
(2) There are now 2 additional felony Arizona DUI offenses.
1) It is now a class 6 felony if a person, while required to operate a vehicle with an ignition interlock device, refuses to provide a sample of his breath, blood, or urine to determine whether he or she is under the influence of alcohol or drugs.
2) It is now a class 4 felony if a person commits a Arizona DUI while required to operate a vehicle with an ignition interlock device.
(3) A person arrested for Extreme Arizona DUI; Aggravated Arizona DUI; or a person under 21 years of age driving with alcohol or drugs in their system will now have their car impounded for 30 days.
(4) A person will also have their car impounded for 30 days in the following circumstances:
1) Driving while their license is revoked for any reason;
2) Driving while their license is suspended for a Arizona DUI conviction;
3) Driving while their license is suspended for a previous Driving on a Suspended License Conviction;
4) Driving while their license is suspended for too many traffic violations;
5) Driving while never having been issued a driver's license from any jurisdiction.
(5) A person who has their driver's license suspended or revoked for 1 year for either:
1) a first offense of refusing to provide a sample of his breath, blood, or urine to determine whether he or she is under the influence of alcohol or drugs;
or
2) for a first conviction for Arizona DUI with a minor in the vehicle
is now eligible for a restricted driver's license for the final 9 months of the 12 month suspension or revocation of their driver's license. Eligibility is subject to certain requirements and a person must drive with an ignition interlock device.
