Arizona DUI Do's and Don'ts

You have certain constitutional rights when stopped by the police. The following is a list of what to do and what not to do when stopped by the police for a DUI.
1) DO provide the police officer with your driver's license, registration, and insurance;
2) DO tell the officer that you want to contact an attorney; An attorney can provide you with advice on your rights in various circumstances. Failure of the police to allow you to contact an attorney may result in the dismissal of your case.
3) DO request an opportunity to obtain an Independent Blood Sample; A second sample of your blood may expose problems with the testing device used by police to obtain your blood alcohol content. Additionally, failure of the police department to provide you with an opportunity to obtain an independent blood sample may result in the inadmissability of your blood alcohol content obtained by the police and/or dismissal of your case.
4) DON'T answer any questions; You are not required to answer any questions other than to provide the police officer with your name/driver's license, your vehicle registration, and your insurance.
5) DON'T perform any Field Sobriety Tests including the eye test. Under Arizona law, you are not required to perform these tests. The results of these tests are commonly used by the prosecutor to gain a conviction even if your blood alcohol level is under the legal limit of .08%.
